الحضانة وأثرها في الأسرة: دراسة في ولاية سلنجور

Abstract

This study is based on the problem of custody that is filed at the Selangor Syariah Court. This study sought to give information and to expose our society pertaining to the rights of custody and its implication in family institutions. The methodology that is used in this study is through by fiqh documents and books on child custody. The result shows that custody gives influence to the children's life due to the divorce between spouses especially in the emotion and though development. Furthermore, it also shows that most of them who claim for custody is the wife's, for the reason that the husband has a temper and fail to execute his responsibility to the children. Then, the finding of this study also shows that the claim is more on the wife because she is the suited with the natural maternal instinct, as she will give love and caring to her children.
